Custom Kit Terms & Conditions

Notice to All Customers:
By placing an order for a custom kit ("Product") with Pedalare ("Company"), you, the Customer, acknowledge and agree to the following terms:
1. Intellectual Property Rights
All designs created by the Company for the Product are the exclusive intellectual property of the Company. The Customer is prohibited from replicating, copying, or using any design provided by the Company for the Product with any other brand or for any purpose other than the use of the Product as intended. The Company retains all rights to the design, including but not limited to the right to reuse, modify, or sell the design, unless a separate written agreement states otherwise.
Where Customer assets (e.g. logos or artwork) are incorporated, the Customer warrants they own or have the rights to use such assets, and grants Pedalare a non-exclusive licence to use those assets for production and promotional purposes unless otherwise agreed in writing.
2. Pricing
The price for each Product will be determined on a per-order basis and is subject to change based on the specifics of the order. At the conclusion of the design process, the Company will provide the Customer with a price for the production of the Product. The Customer has 14 days to accept the price after which time the Company reserves the right to propose a new price. The Company makes no representation as to the applicability of the proposed price to other orders placed with the Company.
3. Minimum Order Quantity
All custom kit orders are subject to minimum order quantities, which will be advised at the quotation stage.
4. Order Fulfilment and Potential Delays
The Customer must approve a final digital design proof before production. The Company is not responsible for errors or omissions approved by the Customer.
Production will commence only after full payment is received. The Customer acknowledges that timelines may shift if payment is delayed.
The Company endeavours to fulfil orders within the estimated time frame; however, makes no guarantee as to delivery time. Orders may be subject to delays due to production shipping, customs, or other unforeseen circumstances. The Company is not liable for any delays caused by factors beyond its control and will communicate with the Customer regarding any significant delays.
5. Sizing and Liability
The Company provides a comprehensive size guide online and offers in-store sizing samples to assist Customers in selecting the appropriate size. The Customer is responsible for ensuring the correct size is selected at the time of order. The Company is not responsible for a Customer purchasing an incorrect size. Exchanges or returns due to incorrect sizing will not be accommodated.
6. Quality Assurance and Product Guarantee
The Company commits to high-quality standards in manufacturing the Product. The Company guarantees the Product in accordance with the applicable standards in the Australian Consumer Law.
7. Cancellation and Changes Policy
Orders may be cancelled or modified within 7 days of order finalisation and prior to production commencing, or such further time as the Company allows. No cancellations or refunds will be accepted once the order has been submitted to manufacturing. Changes requested after final approval may incur additional costs or extend production timelines.
8. Return and Refund Policy
Given the custom nature of the Product, returns and refunds are limited. Specific conditions under which they are accepted will be clearly communicated, provided at all times that the Customer shall be entitled to such rights and remedies as are proved for by the Australian Consumer Law.
9. Care Instructions
Detailed care instructions are provided on https://pedalare.cc/pages/care-instructions, to ensure proper maintenance and longevity.
10. Use and Safety Information
The Product should be used as intended for cycling activities. Safety guidelines for usage will be provided with the Product upon request by the Customer. Although every effort is made to ensure that the Product meets sun protection standards, the Company does not warrant that the Product meets a particular Sun Protection Factor or SPF. Customers are encouraged to take such precautions against sun exposure as are recommended by public health authorities.
11. Customisation Limits
The Company reserves the right to refuse to include any design element in a Product.
12. Delivery and Shipping
Shipping policies, including carriers, estimated delivery times, and costs, will be provided at the time of order. International shipping may be available, subject to additional fees and customs regulations.
Risk in the Product passes to the Customer upon delivery to the shipping carrier. The Company is not liable for delays or damage in transit but will support Customers in claims with the carrier where appropriate.
13. Data Protection and Privacy
Customer data will be collected, used, and protected as per applicable data protection laws. The Company's full privacy policy is available on the website and provided upon request.
14. Feedback and Complaints Procedure
Customers are encouraged to provide feedback through pedalare.cc or hello@pedalare.cc The Company's process for addressing complaints will be transparent and timely.
15. Force Majeure
The Company will not be held liable for failure to perform obligations due to events outside its reasonable control.
16. Legal Compliance
The Company adheres to all relevant local, national, and international laws and regulations in its operations.

17. Limitation of Liability
To the extent permitted by law, the Company excludes all liability for indirect or consequential loss (including loss of profits or business opportunity). The Customer’s sole remedy is limited to repair, replacement, or refund as per Australian Consumer Law.
